Current Legal Status Of Online Gambling In The United States In 2024

As of this writing, Nevada, New Jersey and Delaware have already legalized some type of online gambling for their residents and visitors. Players do have to be physically present inside state borders to be eligible to participate. In these three states, online casino and poker sites are licensed and regulated by the state. There are a number of additional states that are considering getting on board through legalizing online gambling in their own region, and through intrastate compacts which provide access to the online gambling offerings of other states.

While we do expect this trend to expand and eventually cover most of the states in the US, state regulated online gambling is not yet a reality in most of the United States. There are not any federal laws which prohibit US players from participating in playing at offshore Internet gambling sites. Not all state gambling laws are as clear cut as this however. The gambling laws in the majority of US states do not address online gambling at all. The few states that do address online gambling seem to target illegal online gambling operations originating in their own state and do not focus on or target legal offshore gambling sites.

This leaves the door wide open for US participation in licensed and certified online gambling websites which are regulated and located outside of the USA. Despite the fact that most state laws are a little gray when it comes to online gambling, there are not state laws expressly prohibiting players from engaging in legal offshore options at this time. With this topic rising to the forefront more and more, states that are in opposition to online gambling may choose to come up with more stringent laws concerning the players in their state. This guide will keep players informed of updates and changes to state law that take place.

FAQ's For US State Based Legal Online Gambling

Only players that are physically present inside of the state's borders are eligible to participate in their legal online gambling offerings. The state implements geolocation technology into their gaming software to ensure that players outside of their state borders do not have access to their gambling sites.

Residents who live in states which have legalized online gambling and which participate in a intrastate gambling pact with another state will have access to additional online gambling options based on the participants of the compact agreement. Gamblers who are not physically present in one of the states that have already legalized online gambling will not be eligible to participate.

Players in these applicable states must be at least 21 years of age to participate.
